Protecting your data during a CNIL audit

Has the CNIL (French data protection authority) notified you of an audit? You feel the anxiety of having to prove your compliance with strict requirements. Every business faces its own challenges with personal data. Hashtag Avocats knows the possible outcomes of an inspection: a formal notice issued by the President of the CNIL, then, before the restricted committee (formation restreinte), sanctions such as an injunction, a limitation of processing or a fine. We assist you from preparing for the inspection through to your defence if a sanction is imposed.

Meeting the CNIL’s compliance requirements

CNIL compliance demands close attention to detail: how to ensure transparency in data collection, safeguard the security of sensitive information, or update privacy policies. Our team knows that every failing, even a minor one, can be sanctioned. We help you identify and correct these gaps in order to reduce the risk of sanctions.

  • Preparatory audits to assess your practices
  • Compliance work on data processing and contracts
  • Assistance in the event of a CNIL formal notice

Defence against a formal notice or a CNIL fine

Is the CNIL accusing you of a lack of transparency, a lack of consent or insufficient security? Our team knows the available legal remedies and knows how to structure a defence to reduce sanctions and protect your reputation. We assess the situation precisely and adapt a defence strategy that highlights your compliance efforts, while challenging unfounded points against you.

  • Analysis of the grounds for the sanction
  • Preparation of tailored formal responses
  • Drawing up a remediation plan to present to the CNIL

Supporting businesses during an unannounced CNIL audit

When faced with an unannounced inspection, there is no room for improvisation. You must prove that each data processing operation complies. Hashtag Avocats helps you manage the stress and respond effectively to what the CNIL inspectors expect. We assist you in gathering the necessary documents, preparing audit meetings and answering requests for information, with the aim of minimising the potential repercussions.

  • Preparing internal teams for the inspection
  • Managing the documentation to be provided
  • Simulation of inspection scenarios

Preventing the risk of sanctions: a proactive approach

Rather than waiting for an inspection, our team offers you a proactive approach to identify non-compliance risks in advance. Through regular audits, we assess how your compliance with the regulations is evolving and support you in continuously improving your data management practices.

  • Regular compliance audits
  • Updating internal policies in line with regulatory changes
  • Support in raising awareness of CNIL issues among your teams

Understanding CNIL measures: from formal notice to fines and sanctions

CNIL sanctions vary according to the failings found, and can seriously affect your business. When a personal data breach is at issue, the quality of the incident management weighs on the outcome of the procedure. Whether it is a formal notice made public, which is not a sanction but weighs on your image, a fine or a limitation of processing, each measure is a threat to your business. Hashtag Avocats understands that simply receiving a notification of sanction is a source of anxiety. We analyse your file and build a defence aimed at minimising these impacts.

  • Administrative fines of up to €20 million or 4% of annual worldwide turnover
  • Corrective measures, immediate or scheduled
  • Publication of the formal notice (reputational impact)

Reducing the risk of sanctions being published

When the CNIL decides to publish a formal notice, your company’s reputation is at stake. This measure can have direct consequences on the trust of customers and partners. We act to structure a response that minimises these repercussions. In addition, we make sure your right to be heard is respected in order to preserve your company’s reputation and how your customers perceive it.

  • Constructive dialogue with the CNIL
  • Minimising the media impact of the sanction
  • Tailored communication strategy to limit the reach of publications

Restoring compliance after a sanction

After a sanction, you need support to restore trust and secure the compliance of your activities. Hashtag Avocats is committed to assisting you in implementing the corrective measures required by the CNIL. We create with you a detailed action plan, including regular audits and training, so that your company returns to full compliance with regulatory requirements.

  • Drawing up an action plan to close the gaps
  • Training teams on new compliance standards
  • Monitoring the implementation of CNIL recommendations
