Key points

  • A frozen crypto account often results from KYC/AML procedures, which require platforms to check customers’ identity and the source of funds.
  • Some freezes stem from the terms of use, from requisitions by the judicial authorities or from an administrative asset-freezing measure.
  • Authorised platforms must inform their customers in a fair, clear and not misleading manner (Article 66 of the MiCA Regulation), but they cannot disclose that a suspicious transaction report has been made.
  • A lack of precise information or late communication is among the main grounds for challenge.
  • The challenge begins with a formal request to customer service, supported by a well-documented file: correspondence, the notification letter, proof of identity and of the source of funds.
  • If difficulties persist, a crypto lawyer can assess whether the measure is legitimate or disproportionate.

An account freeze is a measure frequently used by crypto platforms when abnormal behaviour is suspected or during an enhanced KYC/AML check. Faced with this blocking of funds, many users wonder what steps they can take to exercise their rights. Challenging an account freeze requires a precise understanding of the applicable legal grounds and of the effective remedies available. This article looks at the legal framework for suspending services, the contractual obligations of operators and the procedure to follow to try to have the block lifted.

Why does a crypto platform freeze an account?

The main cause of an account freeze on a crypto platform is the application of the rules on combating money laundering and terrorist financing (KYC/AML). Platforms are required to identify their customers and verify their identity before entering into a business relationship (Article L. 561-5 of the French Monetary and Financial Code (Code monétaire et financier) (in French)). Where they cannot meet this obligation, they carry out no transaction (Article L. 561-8 of the same Code (in French)). This process sometimes leads to a temporary suspension of access when an inconsistency appears in the supporting documents provided or unusual transactions are detected.

In addition, some freezes result from each operator’s own terms of use. An excessively strict interpretation of certain clauses can lead to unfair practices, in particular where the platform reserves the right to block funds without clear or proportionate justification. Cooperation with the judicial authorities can also lead to the blocking of accounts that are subject to official requisitions. Finally, in terrorism matters, the Minister for the Economy and the Minister of the Interior may jointly decide to freeze funds for six months, renewable (Article L. 562-2 of the Monetary and Financial Code (in French)).

The duty of contractual transparency

Authorised crypto platforms must act honestly, fairly and professionally and provide their customers with information that is fair, clear and not misleading (Article 66 of Regulation (EU) 2023/1114, known as MiCA). This duty of clarity justifies asking for the reasons for the account freeze and the expected duration of the measure. It has one limit, however: where a suspicious transaction report has been sent to Tracfin (French financial intelligence unit), the platform is prohibited from disclosing its existence and content to the customer (Article L. 561-18 of the Monetary and Financial Code (in French)).

A lack of precise information or late communication is among the main grounds for challenge in disputes over blocked funds. Transparency about the exact reason for the freeze helps establish a constructive dialogue between the user and the customer service of the crypto platform concerned.

Regulatory framework and how it applies in practice

In France, the legal framework subjects authorised crypto-asset service providers to anti-money laundering obligations (Article L. 561-2 of the Monetary and Financial Code (in French)): they exercise ongoing due diligence over their customers’ transactions (Article L. 561-6 (in French)). If difficulties persist, a crypto lawyer can assist you. Since 30 December 2024, Regulation (EU) 2023/1113 has also required transfers of crypto-assets to be accompanied by information on the originator and the beneficiary. These obligations nevertheless coexist with the fundamental principles of the right to property and of the free disposal of digital assets.

Striking a balance between regulatory obligations and respect for individual rights frequently gives rise to litigation. A lawyer assesses whether an action is legitimate or disproportionate in light of the file put together by the platform. This professional support makes it possible to build a solid argument against any measure perceived as arbitrary.

What steps should you take to challenge a crypto account freeze?

Challenging an account freeze generally follows several structured steps. You should act quickly to limit the loss caused by the blocking of funds. Several remedies exist, combining an internal approach to customer service followed by external referrals if necessary.

Building a well-documented file remains essential: correspondence with the platform, a copy of the letter notifying the measure, proof of identity or of the source of the frozen sums. Each item helps clarify the chronology of events and document the reality of the account freeze.

Contacting the crypto platform’s customer service

The first step is to send a formal request through customer service. Clearly setting out the circumstances that led to the blocking of funds makes a prompt review of the file easier. Using precise language increases the likelihood of obtaining a reasoned reply from the crypto platform.

At this stage, you should request the lifting of the account freeze and a detailed statement of the reasons for the decision. Filing a complaint is free of charge: crypto-asset service providers must have a complaints-handling procedure and publish a description of it (Article 71 of the MiCA Regulation). Some platforms also offer an internal mediator.

Using a mediator or an out-of-court remedy

If the dialogue with customer service fails, you can refer the matter to an independent mediator. The AMF Ombudsman (médiateur de l’AMF) receives complaints that fall within the remit of the AMF (Autorité des marchés financiers, the French financial markets authority), and referral to the Ombudsman suspends the limitation period for civil action (Article L. 621-19 of the Monetary and Financial Code (in French)). The Ombudsman examines the dispute in light of the contractual framework and the applicable rules.

The mediator analyses allegations of unfair practices, in particular where the legitimacy of the blocking of funds remains uncertain. The aim is to reach an amicable outcome and so avoid taking the dispute straight to court. Preparing a documented file strengthens the credibility of the challenge.

What legal remedies are available to lift a crypto account freeze?

When all internal procedures fail, it becomes possible to bring an action before the competent courts. Several legal grounds allow a claim before the civil courts, in particular the contractual liability of the crypto platform.

A lawyer directs the user to the court with jurisdiction over the case: this may concern a release of the account freeze or a claim for damages where loss results from a failure by the provider. A documented case makes the proceedings more effective.

Admissible grounds and the limits of judicial review

The court assesses the proportionality of the measure blocking the funds in light of the evidence produced by each party. An unjustified account freeze can give rise to the operator’s liability. Conversely, a crypto platform that justifies its action by an identified KYC/AML alert can rely on its legal obligations: if it cannot verify the customer’s identity, it carries out no transaction (Article L. 561-8 of the Monetary and Financial Code (in French)).

A platform can therefore rely on a legal obligation, provided the user is adequately informed within the limits set by law. The success of court proceedings depends on demonstrating an unfair practice or an error by the operator.

Why use a lawyer

Bringing a legal challenge against a crypto platform requires a command of technical rules and raises specific procedural issues. The lawyer assists with the legal characterisation of the account freeze and with developing arguments suited to the sector’s regulations.

Preparing the file, drafting procedural documents and conducting negotiations fall within the advisory role performed by this professional. Coordination with the supervisory bodies makes it possible to assert the rights applicable to the situation.
